GENERAL CONDITIONS OF SALE AND CANCELLATION

1. Object

These general conditions define the rights and obligations of the parties in the context of the remote reservation of services offered by our establishment, Gite les Biches, whose contact details are specified in this reservation confirmation document. They govern all the steps necessary for the reservation and the monitoring of the reservation between the contracting parties. The customer/renter acknowledges having read and accepted these general conditions of sale and the conditions of sale of the reserved rate accessible on our reservation platform.These general conditions of sale apply to all reservations made online, via our Elloha reservation platform.

2. Reservation

The customer/renter chooses the services presented on our reservation platform. He acknowledges having read the nature, destination and reservation methods of the services available on our reservation platform and having requested and obtained necessary and/or additional information to make his reservation with full knowledge of the facts. The customer is solely responsible for his choice of services and their suitability to his needs, such that we cannot be held responsible in this regard. The reservation is deemed accepted by the customer at the end of the reservation process.

3. Booking process

Reservations made by the customer/tenant are made via the dematerialized reservation voucher accessible online on our reservation platform. The reservation is deemed to have been made upon receipt of the reservation voucher. The customer/renter undertakes, prior to any reservation, to complete the information requested on the voucher or reservation request. The customer/renter certifies the truth and accuracy of the information transmitted. After the final choice of the services to be reserved, the reservation procedure includes entering the bank card in the event of a guarantee or prepayment request, consultation and acceptance of the general conditions of sale and the conditions of sale of the reserved rate. before validation of the reservation and, finally, validation of the reservation by the customer/tenant.

4. Acknowledgment of receipt of the reservation

Gite les Biches, via the Elloha reservation platform, acknowledges receipt of the customer/tenant's reservation by sending an email without delay. In the case of online reservation, the acknowledgment of receipt of the reservation by email summarizes the contract offer, the services reserved, the prices, the conditions of sale relating to the selected rate, accepted by the customer, the date reservation made, information relating to after-sales service, as well as the address of the establishment to which the customer/renter can submit complaints.

5. Liability

The photographs presented on the reservation platform are not contractual. Even if all the best efforts are made so that the photographs, graphic representations and texts reproduced to illustrate the establishments presented give as accurate an overview as possible of the services offered, variations may occur between the time of reservation and the day of the reservation. consumption of the service. Gite les Biches cannot be held responsible for the non-execution or poor execution of the reservation in the event of force majeure, due to the third party, due to the client/tenant, in particular the unavailability of the internet network, impossibility of access to the website, external intrusion, computer viruses or in the event of prepayment not authorized by the bearer's bank. Any reservation or payment which is irregular, inoperative, incomplete or fraudulent for a reason attributable to the customer/renter will result in the cancellation of the order at the expense of the customer/renter, without prejudice to any civil or criminal action against the latter. .

6. PAYMENT OF THE RESERVATION/RENTAL

30% deposit is required upon confirmation of the reservation by the owner; the deposit is debited from the bank card sent as guarantee by the Customer/Tenant at the time of booking via the Elloha and Stripe reservation platform.

If the deposit is not paid, the owner of Gite Les Biches cannot guarantee that the reservation will be maintained and reserves the right to regain full freedom.

The balance of the rental will be paid at the latest 2 weeks before the arrival of the Client/Tenant in the Gite Les Biches, or from the day of the reservation if it is made less than 2 weeks from the date of entry. in places.

7. DEPOSIT

When paying the balance of the reservation, the Customer/Renter will receive a second email with a request for pre-authorization in the amount of 800 Euros (eight hundred euros) as a security deposit intended to cover damage and/ or damage to the accommodation and the furniture and objects furnishing the accommodation, caused by the Customer/Tenant, as well as loss of keys or objects. This deposit can also be used in the event of misuse of resources (logs) or energy (practical case: disproportionate increase in radiators/forced H24, turning on radiators and forgetting to turn them off in rooms that are rarely used such as the gym or cinema room, car charging, etc.).

In the absence of the security deposit at the latest the day before arrival and after reminder from the Owner, the contract will be deemed void and the reservation canceled by default of the Customer. In accordance with article 17, no reimbursement would then be made.

The pre-authorization request for depositing the deposit is made via a secure platform (Swikly) and the banking details are recorded securely. The amount of the deposit is not debited and the Client/Tenant's bank limit is not impacted.

An entry/exit inventory via photos will be requested via WhatsApp.

Once the stay has been completed, the deposit expires automatically unless damage is noted and there is a need to cover the costs via the deposit, partially or in full.

The Customer/Tenant has 24 hours to report any disorder or damage they notice upon arrival (broken appliances, stained fabrics, etc.)

Failing this, the Client/Tenant will be deemed to have taken the accommodation in perfect condition and any deterioration, damage or breach noted and not reported to the Lessor may be deducted from the deposit.

8. TOURIST TAX

Gite les Biches is responsible for collecting the tourist tax which applies at the current rate established by each municipality, per night per person over 18 years old.

On the date the contract is established, the tourist tax for the town of Noyers-sur Cher is calculated as follows: 4% Community Stay + 10% Departmental share = Tourist Tax per night and per adult.

Examples:

For 4 people occupying the house in low season, the tourist tax is 1.98 euros per adult per night.

For 8 people occupying the house in low season, the tourist tax is 1.21 euros per adult per night.

The tourist tax costs are added to the rental costs of Gite Les Biches depending on the number of adults declared and will be collected with the rental balance.

Any error or false declaration of the number of adults subject to the tax charge will be compensated by additional invoicing of the tax corresponding to the stay of the undeclared person(s), and the associated tariff supplement if applicable.

9. RENTAL PRICE – CHARGES – ACCOMMODATION CAPACITY

The rental price indicated in the reservation confirmation includes, for the entire duration of the rental, the payment of rental charges (water, electricity, internet access) for accommodating the number of people indicated in the reservation.

Any consumption of electricity or water for use outside the home is STRICTLY PROHIBITED.

Any consumption exceeding €14 excluding tax (€16.8 including tax) per day will be deemed excessive and will be re-invoiced to you (electric vehicle charging, radiators excessively increased).

Any log removal from the barn must be declared for regularization (€1 including tax per log).

If we notice that these instructions are not respected, and in the event of refusal of regularization, a flat rate of €200 will be taken from the deposit.

The owner/Renter of Gite les Biches has the right to refuse entry to the premises or to terminate the contract at any time if the accommodation capacity is exceeded by the Client/Tenant, without any compensation.

The capacity of Gites les Biches is 10 people.

10. ARRIVAL / DEPARTURE – DURATION OF SEASONAL RENTAL

Seasonal rental is granted for the period defined at the time of reservation, non-renewable unless agreed by the owner.

Arrival is from 5 p.m. and at the start of the rental, the owner will give the Lessee the keys according to the terms explained in the email relating to the conditions of arrival and departure sent before arrival at the premises as well as instructions relating to accommodation.

Departure is no later than 10:30 a.m.: The Client/Tenant expressly undertakes to have fully vacated the accommodation on the day of departure at this time, and to hand over the keys to the owner according to the terms explained in the email relating to arrival and departure conditions.

11. ASSIGNMENT AND SUBLEASE

The reservation of Gite Les Biches is concluded intuitu personae for the benefit of the sole Client/Tenant identified at the time of reservation.

Any transfer of the reservation, any total or partial subletting, any provision - even free of charge - are strictly prohibited. The Client/Tenant may not leave the use of the premises, even free of charge and/or by loan, to a person outside their household.

12. OBLIGATIONS OF THE CUSTOMER/TENANT

- The Client/Tenant will peacefully use the rented accommodation and the furniture and equipment and will be responsible for any damage and losses that may occur during the duration of the contract in the premises of which he has exclusive use.

- The Client/Tenant will maintain the rented accommodation and return it to a good state of cleanliness and rental repairs at the end of the contract. If items in the inventory are broken or damaged, the Owner/Renter may claim their replacement value.

- He must avoid any noise likely to disturb neighbors, in particular those emitted by radio, television and other devices.

- The Customer/Tenant will not be able to exercise any recourse against the Owner/Renter in the event of theft and damage to the rented premises.

- It will respect the maximum number of people who can enter the premises.

- The Client/Tenant cannot object to a visit to the premises if the Owner/Renter or his agent so requests.

13. HOUSEHOLD

Alinen and end-of-stay cleaning package is mandatory and is added to the rental when confirming the online reservation. It will in fact be invoiced and debited in full when the balance is paid by credit card.

You nevertheless undertake to:

• Place your pillowcases, duvet covers and towels at the foot of each bed. The mattress pads, pillow protectors and decorative cushion covers should be left in place.

• Empty the dishwasher and put away the used dishes and utensils

• Empty the bins and place the packaging (all kinds, recyclable, glass) in the public containers (located 400m away, in the Patapain car park).

• Empty the cupboards and fridge-freezer of consumables brought with you.

• Empty the charcoal from the barbecue and scrape the grate if used

• Clean the stove and its ash container if used

• Make the garden clean

If the accommodation is returned in excessively dirty condition, the owner may deduct the amount of €100 from the deposit for cleaning costs.

14. ANIMAL

To preserve the quality of the equipment and the comfort of the house, animals are not accepted in the gite les Biches.

15. INSURANCE

The Client/Tenant has taken out comprehensive insurance to protect against rental risks (water damage, fire, etc.). A copy of the insurance policy may be requested by the Owner/Renter from the Client/Tenant upon entering the premises.

16. WIFI

Wifi is available to you free of charge.

The Owner/Renter cannot be held responsible for the quality of the Internet provider's network.

No refunds or discounts will be made in the event of service interruption.

17. CANCELLATION POLICY

Up to 30 days before arrival, free cancellation: the 30% deposit is refunded less the management fee of €10.

Between 29 days and 15 days before arrival , 30% of the amount of your reservation

Between 14 days and 7 days before arrival: 50% of the amount of your reservation

Between 7 days and the day of arrival , 100% of the reservation amount, no refund or credit will be made, whatever the reason.

After entering the premises, any early departure of the Client/Tenant will not give rise to any refund, whatever the reason.

We therefore strongly advise our customers/renters to take out cancellation insurance also covering Covid-19.

The reservation can be modified up to 30 days before arrival, subject to availability and only for the current calendar year.

18. Respect for privacy

The customer is informed, on each of the personal data collection forms, of the obligatory or optional nature of the responses by the presence of an asterisk. The information processed is intended for the establishment, elloha.com, its entities, its partners, its service providers (and in particular online payment providers). The customer authorizes elloha.com to communicate his personal data to third parties on the condition that such communication proves compatible with the carrying out of the operations incumbent on elloha.com under these general conditions and in connection with the Customer Protection Charter personal data. In particular when paying online, the customer's bank details must be transmitted by the payment provider stripe.com to the establishment's bank, for the execution of the reservation contract. The customer is informed that this data transfer may therefore take place in foreign countries that do not have adequate protection of personal data within the meaning of the Data Protection Act. However, the customer consents to this transfer necessary for the execution of his reservation. Constellation SAS / Stripe.com, in their professional capacity, have committed to the establishment to take all security measures and respect data confidentiality for said data transfers.

19. Convention of proof

Entering the required banking information, as well as acceptance of these general conditions and the voucher or reservation request, constitutes an electronic signature which has, between the parties, the same value as a handwritten signature. Computerized records kept in elloha.com's computer systems. will be kept in reasonable security conditions and considered as proof of communications, orders and payments between the parties. The customer is informed that his IP address is recorded at the time of booking.

20. Force majeure

Force majeure means any event external to the parties which is both unpredictable and insurmountable and which prevents either the client or the establishment from fulfilling all or part of the obligations provided for in the contract. Force majeure or fortuitous events are those usually recognized by the case law of French Courts and Tribunals. Each party cannot be held responsible towards the other party in the event of non-performance of its obligations resulting from an event of force majeure. It is expressly agreed that force majeure suspends, for the parties, the execution of their reciprocal obligations and that each party bears the burden of the resulting costs.

21. Dispute resolution

These General Conditions of Sale are governed by the law of the country of establishment without hindering any mandatory protective provisions that may be applicable in the country of residence of consumers.

22. Completeness

These General Conditions of Sale, the conditions of sale of the rate reserved by the customer, and the voucher or reservation request express the entirety of the obligations of the parties. No general or specific conditions communicated by the customer can be integrated into these general conditions. The documents forming the contractual commitments between the parties are, in descending order of priority, the voucher or reservation request (including the special conditions of the reserved rate) and these general conditions. In the event of a contradiction between the reservation voucher and the general conditions, the provisions appearing on the reservation voucher will be the only ones applicable to the obligation in question. These general conditions of internet sale may be modified and/or supplemented at any time by the establishment. In this case, the new version of the general conditions of sale via internet will be put online by the establishment. As soon as it is posted online, the new version of the general conditions of sale via internet will automatically apply to all customers.
